I. Terms and Conditions of Booking and Participation

These Terms and Conditions form the agreement between RaRe Fiji Adventures (referred to as “we,” “us,” or “the Company”) and you (the “Client”) regarding the booking and participation in any tour, activity, or service offered by the Company. By booking a tour, you agree to these T&Cs.

1. Booking and Payment

1.1 Reservation: A booking is only confirmed upon receipt of a completed booking form and the required non-refundable deposit or full payment, as specified at the time of booking.

1.2 Final Payment: The outstanding balance must be paid no later than [Insert Number, e.g., 30] days before the scheduled departure date. Failure to pay by the due date may result in the cancellation of your booking without refund of the deposit.

1.3 Pricing: Prices are subject to change without notice until a booking is confirmed and paid in full.

2. Assumption of Risk and Liability

2.1 Inherent Risk: The Client acknowledges that adventure travel, particularly in a remote location like Fiji, involves inherent risks, including, but not limited to, changes in weather, challenging physical activity, remote travel, and potential delays or cancellations.

2.2 Waiver: Prior to participation, all Clients must sign a Liability Waiver and Release Form provided by the Company. Failure to sign this document will result in exclusion from the tour with no refund.

2.3 Authority of the Guide: The Client agrees to abide by the decisions and instructions of the Company’s guides or representatives. If a Client’s behavior endangers themselves, others, or the environment, or causes significant disruption, the guide may, at their discretion, remove the Client from the tour without any right to a refund.

3. Client Responsibility

3.1 Insurance: The Client must possess adequate and valid travel insurance, including coverage for personal accident, medical expenses, evacuation and repatriation, and cancellation. The Company is not responsible for any costs incurred due to lack of insurance.

3.2 Health and Fitness: The Client is responsible for ensuring they are medically fit and healthy enough to participate in the booked activity. The Client must fully disclose all relevant health and medical information during the booking process.

4. Limitation of Liability

The Company and its agents, employees, and partners are not liable for any personal injury, property damage, loss, delay, or expense resulting from events beyond the Company’s control, including but not limited to, acts of God, extreme weather, force majeure, acts of government, or failure of local services.

5. Governing Law

This agreement is governed by the laws of Fiji. Any legal action related to these terms shall be brought exclusively in the courts of Fiji.

II. Refund & Cancellation Policy

1. Customer-Initiated Cancellations

The amount of your refund depends on how far in advance of the tour departure you notify us via email at bookings@rarefijiadventures.com:

| 14 to 29 Days | 50% Refund of the total tour price. |

| Less than 14 Days | No Refund will be issued, as we will have incurred non-recoverable costs (staffing, supplies, etc.). |

2. Company-Initiated Cancellations (Safety & Weather)

 * Safety Cancellation: If RaRe Fiji Adventures cancels a tour due to severe weather, unsafe conditions, or operational circumstances before departure, you will be given the choice of:

   * A Full Refund of the tour price.

   * An equivalent Reschedule to another available date.

 * Mid-Tour Cancellation: If a tour is cut short due to safety concerns after it has started, we will evaluate the percentage of the trip completed and offer a partial refund or credit on a case-by-case basis.

3. Exceptions and Non-Refundable Situations

 * No-Shows: Failure to appear at the designated meeting point at the scheduled departure time is considered a No-Show, and No Refund will be given.

 * Third-Party Services: We cannot refund expenses incurred for separate services, such as flights, accommodations, or travel insurance booked by the Client.

4. Refund Processing

All refunds will be issued back to the original form of payment used for the booking. Please allow 7 to 10 business days for the refund to be processed by us and appear back in your account.

III. Privacy Policy

1. Information We Collect

We collect personal information necessary to manage your booking, ensure your safety, and communicate with you.

 * Booking and Contact Data: Name, date of birth, nationality, email address, phone number, and physical address.

 * Safety and Activity-Specific Data (Critical): Emergency contacts, allergies, dietary requirements, and existing medical conditions that may affect your participation.

 * Usage Data: Non-personal information about your website visit (IP address, browser type) to help improve our website.

2. How We Use Your Information

We use your data for the following purposes:

 * To Fulfill Bookings: To process and confirm your tour reservation and manage payments.

 * For Safety: To inform our guides and staff of any health or dietary needs to ensure your well-being and meet safety standards during the adventure.

 * Communication: To send you updates, confirmations, and important safety alerts related to your booked tour.

 * Marketing (Opt-in): If you opt-in, we use your email to send promotional offers and newsletters.

3. Sharing and Disclosure of Your Information

 * Local Partners: We share essential booking and safety information (e.g., name, health notes) with local Fijian guides, boat captains, and transportation providers who are directly involved in executing your tour.

 * Legal Compliance: We may disclose your information if required to do so by law, court order, or governmental regulation.

4. Data Security

Information collected for safety purposes is treated with the highest level of confidentiality and is deleted promptly after the conclusion of your tour, unless required for legal retention purposes (e.g., signed waivers). We take reasonable steps to protect your personal data from misuse or unauthorized access.
